After you sign the release, several things have to happen before the check clears: the insurer issues funds, the money passes through the firm trust account, and every lien is resolved. Here is the disbursement process and what actually causes the delay.

"I signed, so where is my money?" is one of the most common questions after a settlement. The honest answer is that signing the release starts the disbursement process; it is not the finish line. Here is what happens between the signature and the check.

Step 1 — The release goes back and the insurer issues funds

After the signed release and any required documents reach the insurer, it issues the settlement funds. This often takes a few weeks, though it varies by carrier and case.

Step 2 — Funds are deposited into the firm trust account

Settlement funds do not go straight to the client. They are deposited into the firm's client trust account, usually an IOLTA account, and generally must clear before anything is paid out. Holding client funds separately and disbursing only cleared funds is required under attorney trust-accounting rules, such as ABA Model Rule 1.15 and its state equivalents.

Step 3 — Liens and reimbursement claims are resolved

This is usually the longest part. Before the client is paid, the firm has to finalize every lien and reimbursement claim: hospital, health plan, Medicare, and Medicaid. Medicare's final demand in particular can take weeks to months, and paying the client before these are resolved creates real exposure.

Step 4 — The settlement statement

The firm prepares a settlement statement showing the gross recovery, attorney fees, case costs, each lien payoff, and the client's net. The client reviews and signs it.

Step 5 — Disbursement

Once funds have cleared and payoffs are confirmed, the firm disburses: it pays the lienholders and costs and issues the client's net.

So how long does it take?
